Can I Stop my Divorce from Happening?

Imagine the scene: your husband comes home after work and tells you he wants a divorce. He tells you he hasn’t been happy for quite a while and wants out.

You’re floored. You had no idea. I mean, you had problems like everyone else, but not this bad (or so you thought).

And you don’t want to get divorced. You still love your husband. What can you do?

Unfortunately, there’s not much under Utah divorce law. Since Utah is a no-fault divorce state (click here to see what this means), you can’t legally stop a divorce from happening.

You might be able to delay the divorce, but you can’t stop it.

Since you can’t stop a divorce legally, your only real recourse is to find someway to reconcile.

Now, I’m a divorce attorney, so I might not be the best person to ask how one successfully goes about reconciling. That heavy lifting is done by you, your family, your religious leader, your marital therapist. The law cannot save your marriage if your spouse wants out.

I can tell you, however, that reconciling outside of court is the only way to save your marriage.

(Note: there is a way to “call a time out” in your divorce. It’s called a petition for conciliation. It doesn’t postpone the process for long, but it’s something. If you would like more information about this, click here.)
