I'm about to File for Divorce and my Spouse Doesn't Know: How Should I Prepare?

So, you've made the decision to divorce. You've found a good attorney and drafted a Divorce Complaint. You're ready to file.

Only problem is you haven't told your spouse you're getting divorced. 

Sometimes, you just can't tell your spouse until that day comes. And sometimes, telling in advance is just not safe -- especially in domestic violence situations. Don't worry; it happens more often than you would think.

What should you do if you find yourself in this sort of situation? Here are few suggestions.

1. Divide the bank accounts.

If you have joint accounts, divide them 50/50. Take half the money out and put it in a separate bank account to which your spouse has no access. I have never had a client get in trouble with a judge when he or she removed half the money in the joint accounts. (I have had client's get in trouble for removing 95% of the account, so don't pull that sort of thing.)

2. Have a plan in case things might turn violent.

Especially in divorces involving domestic violence, have a plan to ensure you are safe when you break the news. Whether that is breaking the news over the phone, or having someone with you when you do it, make a plan.

3. Have family standing by.

Divorce is difficult, and you will need your family to help you through it. Let them know what is going on, and lean on them through the divorce process. 

Bottom line

Bottom line is: be prepared. Don't trust your spouse will accept everything and be hunky-dory. Secure your money and be sure you're safe.
